PLEASE READ THESE WEBSITE SERVICES TERMS CAREFULLY BEFORE PURCHASING, BOOKING, APPROVING, OR PROCEEDING WITH WEBSITE DESIGN, SHOPIFY, ECOMMERCE, WEBSITE CONFIGURATION, WEBSITE SUPPORT, OR RELATED SERVICES FROM A&P CREATIVE, INC.
These Website Services Terms supplement and form part of the A&P Creative, Inc. Terms & Conditions, Return Policy, Privacy Policy, applicable product or service descriptions, checkout terms, accepted quotes, invoices, proposals, and other written terms provided in connection with a website project.
1. Website Services
A&P Creative, Inc. may provide website design, Shopify setup or configuration, ecommerce setup, theme setup or customization, page creation, navigation configuration, product setup, collection setup, content implementation, responsive formatting, basic search engine optimization configuration, contact forms, integrations, website strategy, launch support, training, and related services.
The exact services included in a project are limited to those expressly identified in the applicable package, product description, accepted quote, proposal, invoice, checkout description, or written agreement.
Services, functionality, deliverables, meetings, revisions, products, pages, integrations, configurations, or other work not expressly identified as included are not included in the project price.
2. Streamlined and Promotional Website Packages
Certain website services may be offered as limited, promotional, community, seasonal, or streamlined packages. These packages use a predefined scope and streamlined production process in order to provide services at promotional pricing.
Promotional or streamlined packages are separate from A&P Creative, Inc.'s standard website, Shopify, strategic, custom development, or expanded website system services.
Promotional pricing applies only to the package purchased and does not establish the price of future work, additional services, custom projects, or standard A&P Creative, Inc. website services.
3. Community Fall Website Special
The A&P Creative Community Fall Website Special is a limited promotional website offering available only while designated project capacity remains available.
Unless extended by A&P Creative, Inc. in writing, the Community Fall Website Special expires on October 14, 2026 at 11:59 p.m. Eastern Time, or earlier if all available promotional project openings are reserved.
Purchasing or reserving a promotional package before the expiration date does not require the website to be completed by October 14, 2026. Project scheduling and completion remain subject to onboarding requirements, client readiness, production availability, project complexity, third-party requirements, and these Website Services Terms.
Promotional pricing may not be applied retroactively to prior purchases, exchanged for other services, or extended after expiration except at A&P Creative, Inc.'s discretion.
4. Project Scope
The project scope is determined by the service description in effect at the time of purchase together with any applicable quote, proposal, invoice, checkout description, or written agreement.
Where a package includes up to four core pages, the client may select up to four standard website pages appropriate to the project. Unless otherwise stated, each core page may include up to five standard content sections.
Unused pages, sections, products, meetings, revision allowances, or other included capacity have no cash value and may not be exchanged, transferred, accumulated, credited, or substituted for other services.
5. Ecommerce and Product Setup
Where ecommerce product setup is expressly included, A&P Creative, Inc. will configure up to the number of products stated in the purchased package using information and materials provided by the client.
For promotional packages that include simple product variants, each included product may contain up to the stated number of simple purchasable variants or configurations.
Complex variant structures, extensive option combinations, subscriptions, bundles, personalization, conditional pricing, custom product builders, advanced inventory structures, wholesale functionality, custom applications, or advanced ecommerce functionality are outside the package scope unless expressly stated.
6. Client-Provided Content and Materials
The client is responsible for providing complete, accurate, current, organized, and usable project materials in a timely manner. Project materials may include business information, final website copy, logos, brand assets, photographs, product images, product descriptions, prices, contact information, social links, policies, account access, business hours, shipping information, inventory information, and other materials reasonably necessary to perform the project.
Unless copywriting, photography, branding, legal policy drafting, product data preparation, image creation, or another content service is expressly included, A&P Creative, Inc. is not responsible for creating those materials as part of the website package.
The client represents and warrants that the client owns, licenses, or otherwise has the legal right to use all content and materials provided to A&P Creative, Inc.
7. Project Start
Website project work may begin after applicable payment requirements, onboarding requirements, and required project information have been received.
Project work is considered to have begun when A&P Creative, Inc. begins any project-specific activity, including onboarding review, project preparation, kickoff preparation or participation, planning, research, organization of client materials, platform setup, theme setup, page or section creation, design work, content implementation, navigation configuration, product setup, technical configuration, testing, or other services performed specifically for the client's project.
8. Estimated Project Timeline
Website project timelines vary depending on the selected package, project requirements, client readiness, content availability, feedback and approvals, requested functionality, technical considerations, third-party services, and A&P Creative, Inc.'s production schedule.
For streamlined website packages, A&P Creative, Inc. generally targets an estimated completion window of approximately 4 to 12 weeks after all project start requirements have been satisfied.
This timeframe is an estimate only and is not a guaranteed delivery or launch date. The estimated timeline does not begin solely on the date of purchase.
Client delays, delayed approvals, incomplete materials, changes in scope, third-party platform issues, technical limitations, force majeure events, or circumstances outside A&P Creative, Inc.'s reasonable control may extend the estimated project timeline.
9. Payments, Cancellations, and Refunds
Website projects are custom service engagements involving professional time, preparation, expertise, planning, reserved availability, creative work, technical work, intellectual property, and business resources.
Once project work has begun, amounts paid toward the project are nonrefundable to the fullest extent permitted by applicable law.
Client cancellation, change of mind, business changes, preference changes, failure to provide required materials, failure to participate, project delays caused by the client, dissatisfaction with subjective creative preferences, or a decision not to use or launch completed work does not automatically create a right to a refund, credit, chargeback, replacement service, or additional unpaid work.
Refund and cancellation matters are also governed by the A&P Creative, Inc. Return Policy and Terms & Conditions.
10. Included Meetings
Where stated in the purchased package, website services may include one initial project kickoff meeting of up to 60 minutes and one final website walkthrough meeting of up to 60 minutes.
Additional meetings, strategy sessions, training, consulting, implementation assistance, troubleshooting, or support are outside the package scope unless expressly included.
Unused meeting time has no cash value and may not be exchanged for additional pages, revisions, products, services, development time, consulting, or other work.
11. Website Quick Start Guide
Where expressly included, A&P Creative, Inc. will provide a Website Quick Start Guide summarizing key website components or functionality configured as part of the project and providing reasonable basic information related to use or management of the completed website.
The guide is a practical handoff resource and is not an exhaustive technical manual, continuing training program, platform certification, maintenance agreement, legal compliance guide, or substitute for documentation provided by the applicable website platform or third-party provider.
12. Revisions
Where a package includes one revision round, one revision round means one consolidated submission of requested changes following presentation of the initial website build or applicable project milestone.
Revision requests must remain within the original project scope. Additional revision submissions, changes to previously approved work, substantial changes in creative direction, new concepts, newly requested functionality, replacement content submitted after implementation, new products, additional pages, new integrations, or other requests outside the original scope are additional work.
A revision is not a redesign or expansion of the original project scope.
13. Additional Services and Changes in Scope
During a website project, the client or A&P Creative, Inc. may identify additional services, functionality, technical requirements, integrations, software, applications, licenses, content needs, or other work that was not included in the original package.
Additional services are not included merely because they are discussed, recommended, requested, identified, or determined to be useful during the project.
Additional work will be quoted separately based on the nature, scope, complexity, requirements, and availability associated with the request. A&P Creative, Inc. will communicate applicable additional charges before performing separately billable work.
The client may approve the additional work, modify the request to remain within the original project scope, or decline the additional work.
If an additional service, software, application, integration, license, or technical requirement is reasonably necessary to provide functionality requested by the client and the client declines the related additional cost, A&P Creative, Inc. is not obligated to provide that functionality through an alternative method within the original project price.
14. Client Changes and Project Delays
The client agrees to provide timely materials, access, feedback, approvals, decisions, and communications necessary for completion of the project.
If required materials, account access, content, approvals, feedback, or decisions are not provided when reasonably requested, A&P Creative, Inc. may pause the project or move the project to the next available production opening.
Projects that remain inactive for 30 consecutive calendar days because of client delay or lack of response may be placed on inactive status. Reactivation may be subject to current availability, revised scheduling, updated third-party requirements, and an additional reactivation or project fee where appropriate.
15. Domain, Email, Hosting, and Third-Party Costs
Domain registration, domain purchase, domain renewal, domain transfer, domain connection or configuration, business email setup or migration, website platform subscriptions, hosting fees, premium themes, paid applications, plugins, extensions, licenses, stock photography, premium fonts, payment processing fees, and other third-party expenses are not included unless expressly stated otherwise.
Domain setup or connection and business email services may be available as separately purchased services.
The client is responsible for all ongoing third-party subscriptions, renewals, transaction fees, hosting expenses, platform fees, licensing costs, and similar charges associated with operation of the website.
16. Third-Party Platforms and Account Access
Website projects may require access to third-party platforms or client-controlled accounts. The client authorizes A&P Creative, Inc. to access and make changes to authorized accounts solely as reasonably necessary to perform the purchased services.
Where a platform provides collaborator, administrator, partner, delegated, or similar access, clients should use those access methods rather than transmitting personal passwords whenever reasonably available.
The client remains responsible for ownership, security, recovery information, billing, permissions, user access, and continued operation of client-controlled third-party accounts.
A&P Creative, Inc. does not control third-party platforms and is not responsible for outages, platform changes, restrictions, security incidents, application failures, compatibility issues, pricing changes, approval decisions, account suspensions, discontinued functionality, or other matters outside A&P Creative, Inc.'s reasonable control.
17. Ecommerce Client Responsibilities
Clients selling products or services through a website remain responsible for their business operations and legal obligations, including product information, pricing, inventory, product claims, shipping practices, fulfillment, taxes, refunds, returns, customer service, privacy practices, intellectual property rights, regulatory requirements, required disclosures, warranties, subscriptions, payment processor requirements, and the legality of products or services offered.
A&P Creative, Inc. does not provide legal, tax, accounting, regulatory, or compliance advice through a standard website package. Placement or formatting of client-provided policies does not constitute legal review, legal drafting, certification, or approval of those policies.
18. Search Engine Optimization and Performance
Basic SEO setup, where included, is limited to the on-page or technical configuration described in the applicable service package.
Basic SEO setup is not an ongoing SEO campaign, content marketing program, search strategy engagement, backlink service, ranking guarantee, or continuing optimization service.
A&P Creative, Inc. does not guarantee search rankings, traffic, leads, sales, conversions, revenue, profitability, payment processor approval, financing approval, customer acquisition, or other business results.
19. Website Review, Approval, and Launch
The client is responsible for reviewing website content, links, products, prices, contact information, policies, functionality, spelling, business information, and other client-facing materials before final approval and launch.
Client approval authorizes A&P Creative, Inc. to proceed with launch, transfer, publication, or final delivery as applicable.
A&P Creative, Inc. is not responsible for client-approved errors or for changes made after approval by the client, the client's employees or contractors, third-party applications, website platforms, or other third parties.
20. Post-Launch Corrections and Maintenance
Where expressly included, A&P Creative, Inc. will correct technical errors within the original project scope that are reported within 7 calendar days following launch.
This limited correction period does not include new content, design preferences, new functionality, additional products, additional pages, new integrations, ongoing training, website management, maintenance, third-party platform changes, client-created changes, or other additional work.
Unless expressly included in a purchased package or separate agreement, ongoing website maintenance, monitoring, security management, content updates, product management, platform management, technical support, or continuing website administration is not included.
21. Intellectual Property and Project Materials
Website projects are subject to the intellectual property provisions contained in the A&P Creative, Inc. Terms & Conditions.
A&P Creative, Inc. retains all rights in its pre-existing materials, methods, processes, systems, frameworks, templates, reusable components, design approaches, strategies, know-how, and other proprietary intellectual property.
Third-party themes, applications, software, fonts, images, plugins, platforms, and other licensed materials remain subject to the terms and licenses of their respective owners.
No intellectual property rights are transferred except as expressly provided in the applicable written agreement and after all required payments have been received.
22. Portfolio Use
Website projects are subject to the portfolio and marketing provisions contained in the A&P Creative, Inc. Terms & Conditions. Unless otherwise agreed in writing, A&P Creative, Inc. may reference or display publicly available completed website work, screenshots, client names, non-confidential project descriptions, and similar public-facing materials for portfolio, case study, marketing, promotional, educational, or business purposes.
23. No Additional Services by Implication
A website package includes only the services expressly stated in the applicable service description, quote, proposal, invoice, checkout terms, or written agreement.
No service, functionality, deliverable, support obligation, maintenance obligation, training obligation, integration, compliance service, strategy service, development service, or other work will be considered included based solely on assumption, industry practice, conversation, recommendation, prior engagement, or the client's belief that such service is ordinarily associated with website development.
24. Relationship to Other A&P Creative Terms
These Website Services Terms supplement the A&P Creative, Inc. Terms & Conditions, Privacy Policy, Return Policy, applicable checkout terms, service descriptions, invoices, quotes, proposals, and written agreements.
All limitation of liability, indemnification, intellectual property, confidentiality, payment, refund, dispute resolution, arbitration, governing law, chargeback, electronic signature, and other protections contained in the A&P Creative, Inc. Terms & Conditions continue to apply to website projects.
25. Acceptance
By purchasing, booking, approving, paying for, authorizing, or proceeding with website services, the client acknowledges that the client has reviewed the applicable service description and Website Services Terms and agrees to be bound by them together with the A&P Creative, Inc. Terms & Conditions and other applicable policies.
